Terms and conditions of sale

1. Purpose and scope

These terms and conditions of sale apply to all orders placed on prodiagauto.com, published by ProDiagAuto, Annissa Hamami-Imbaut EI, RCS Vienne 130 939 424 (see the Legal notice). They apply to business customers (garages, dealerships, rental companies, car cleaning businesses, etc.) as well as to consumers. Placing an order implies full acceptance of these terms.

2. Products

ProDiagAuto sells car cleaning consumables and accessories, individually or in kits. The essential characteristics of each product are shown on its product page. It is the customer's responsibility to check that the product suits the intended use before ordering. Photographs are not contractually binding.

3. Prices

Prices are shown in euros. VAT not applicable, article 293 B of the French General Tax Code. Shipping costs are shown before the order is confirmed. For deliveries outside the European Union, customs duties and local taxes may be payable by the recipient. Products are sold at the price in force when the order is confirmed.

4. Orders

An order is final once payment has been confirmed. A confirmation email is sent to the customer. ProDiagAuto reserves the right to cancel an order in the event of a payment dispute, an obvious pricing error or product unavailability; the customer is then refunded in full.

5. Payment

Payment is made in a single instalment when ordering, using the methods offered at checkout. Transactions are secured by our payment provider; ProDiagAuto never has access to bank details.

6. Delivery

Products are shipped with a tracking number, sent by email when the parcel leaves. Delivery times shown are estimates. On receipt, the customer checks the parcel in the presence of the courier and notes any damage. Detailed terms are set out in the Shipping policy.

7. Right of withdrawal (consumers)

In accordance with articles L.221-18 et seq. of the French Consumer Code, consumers have 14 days from receipt to withdraw, without giving a reason, by writing to us via the Contact page or at prodiagauto.contact@gmail.com. The product must be returned complete, unused and in its original packaging within 14 days of withdrawal. Return shipping costs are borne by the customer. The refund, including the original delivery costs (based on the standard rate), is made within 14 days of withdrawal; it may be withheld until the returned product is received.

8. Business customers

The right of withdrawal does not apply to purchases made in the course of a professional activity. Any damaged or non-conforming product must be reported in writing within 3 days of receipt. ProDiagAuto's liability towards a business customer is limited to the amount of the order concerned.

9. Legal warranties

Consumers benefit from the legal warranty of conformity (articles L.217-3 et seq. of the French Consumer Code, 2 years from delivery) and the warranty against hidden defects (articles 1641 et seq. of the French Civil Code). Business customers benefit from the warranty against hidden defects. No additional commercial warranty is granted.

10. Liability

Products must be used in accordance with their instructions and good practice. ProDiagAuto cannot be held liable for damage resulting from misuse or from a product unsuitable for the surface being treated.

12. Mediation and disputes

In the event of a dispute, the customer first contacts ProDiagAuto via the Contact page or at prodiagauto.contact@gmail.com to seek an amicable solution. In accordance with articles L.612-1 et seq. of the French Consumer Code, consumers may then use the following consumer mediator free of charge:

These terms are governed by French law. Failing an amicable agreement, the French courts have jurisdiction.
